Terms of Service

1. Description of Service
TintPass is a Management Services Organization (MSO) that provides an online platform connecting patients with independently licensed Texas physicians for the purpose of obtaining medical evaluations related to window tint exemptions under Texas Transportation Code §547.613. TintPass facilitates the intake process, payment, and delivery of digital exemption cards.
2. TintPass Is Not a Medical Practice
TintPass is NOT a medical practice and does not provide medical advice, diagnoses, or treatment. All medical evaluations are conducted by independently licensed Texas physicians who exercise their own independent medical judgment. The physician-patient relationship exists solely between you and the evaluating physician, not between you and TintPass. TintPass provides administrative and technology services only.
3. No Guarantee of Approval
Submitting an application through TintPass does not guarantee approval for a medical exemption. The evaluating physician exercises independent clinical judgment in determining whether you qualify for a medical exemption. The physician may approve, deny, or request additional information at their sole discretion.
4. Refund Policy
If the evaluating physician does not approve your medical exemption application, you will receive a full refund of the service fee. Refunds will be processed to the original payment method within 5-10 business days. If your exemption is approved, the service fee is non-refundable.
5. User Responsibilities
By using TintPass, you represent and warrant that:
- You are at least 18 years of age.
- You are a resident of the State of Texas.
- All information you provide is truthful, accurate, and complete to the best of your knowledge.
- You will not provide false or misleading medical information.
- You understand that providing false information may result in denial of your application and may have legal consequences.
- You will use the exemption card only for the vehicle specified in your application.
6. Account Security
You are responsible for maintaining the confidentiality of your account credentials, including your email address and password. You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. TintPass is not liable for any loss arising from unauthorized access to your account.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TINTPASS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE.
8. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TINTPASS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. TINTPASS DOES NOT WARRANT THAT ANY EXEMPTION WILL BE ACCEPTED BY LAW ENFORCEMENT OR INSPECTION STATIONS.
9. Intellectual Property
All content, trademarks, service marks, logos, and intellectual property displayed on the TintPass website and platform are the property of TintPass or its licensors. You may not reproduce, distribute, modify, or create derivative works from any content on our platform without our prior written consent.
10. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of TintPass services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration conducted in Dallas County, Texas, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit. Nothing in this section shall prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction.
11. Modification of Terms
We reserve the right to modify these Terms of Service at any time. Material changes will be posted on this page with an updated effective date. Your continued use of our services after any changes constitutes acceptance of the modified terms. It is your responsibility to review these Terms periodically.
12. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
13. Termination
We may suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use the service will immediately cease. Provisions that by their nature should survive termination shall survive, including but not limited to limitation of liability, disclaimer of warranties, and dispute resolution.
